Article 1: Purpose
These General Terms and Conditions of Sale govern the sale of Products by HOTEL MUNIER AU TILLEUL to consumer Customers via the Site: https://hotel-tilleul.fr/ . The Customer is clearly informed and acknowledges that the Site https://hotel-tilleul.fr/ is intended for both consumers and professionals, but that these General Terms and Conditions of Sale govern the sale of Products to consumers only.

Article 2: Acceptance of terms and conditions
The Customer undertakes to read these General Terms and Conditions of Sale carefully and to accept them, before proceeding with the payment of an Order for Products placed on the https://hotel-tilleul.fr/ website.

The present General Terms and Conditions are referenced at the bottom of each page of the https://hotel-tilleul.fr/ website by means of a link and must be consulted before placing an Order. The Customer is invited to carefully read, download and print the General Terms and Conditions of Sale, and to keep a copy.

HOTEL MUNIER AU TILLEUL advises the Customer to read the General Terms and Conditions of Sale with each new Order, as the latest version of the said Terms and Conditions applies to all new Orders for the Product.

By clicking on the references to add products to the basket and then on the “Confirm my order” button to place the Order, the Customer acknowledges having read, understood and accepted the General Terms and Conditions without limitation or condition.

Article 3: Definitions
The terms used below have the following meaning in these General Terms and Conditions of Sale:
– Customer”: refers to the co-contractor of https://hotel-tilleul.fr/, who warrants that he/she is a consumer as defined by French law and jurisprudence. In this respect, it is expressly stipulated that the Customer is acting outside of any usual or commercial activity.
– Order”: refers to the purchase of Products by a Customer on the Site: https://hotel-tilleul.fr/
– Account”: refers to the space dedicated to the Customer and associated with all the data supplied by the Customer, hosted on the https://hotel-tilleul.fr/ website. Access to the Account is via the e-mail address and password defined by the Customer.
– Delivery”: refers to the first presentation of the Products ordered by the Customer at the delivery address indicated at the time of the Order on a delivery platform chosen by the Customer. Delivery is therefore carried out by a third party and is not the responsibility of https://hotel-tilleul.fr/.
– Products”: refers to all products marketed by https://hotel-tilleul.fr/ on the Site, namely fresh food products, delicatessen products, alcoholic and non-alcoholic beverages and accessories.
– Restaurants”: refers to the restaurants https://hotel-tilleul.fr/ and the pick-up points for Products ordered “to go” on the Site.
– Withdrawal”: refers to the procedure by which the Customer may collect the Product from the chosen Restaurant, after having placed an Order on the Site.
– Site”: refers to the https://hotel-tilleul.fr/ website accessible at the following address: www.https://hotel-tilleul.fr/ .fr
– Territory”: refers to the areas within a radius of 4 kilometers of the Restaurants where Orders are collected.

Article 4: Purchase of products on the SITE: https://hotel-tilleul.fr/
In order to purchase a Product, the Customer must be at least 18 years of age and have legal capacity.

Article 5: Orders

Article 5.1. Product characteristics

These elements appear on the product sheets on the Site and contain in particular the description, allergens, instructions for use and price.
The Customer undertakes to read this information carefully before placing an Order on the Site. The Customer must find out about any food allergies or intolerances before ordering a Product on the Site.

https://hotel-tilleul.fr/ garantit au Client le respect de la chaîne du froid jusqu’au Retrait des Produits dans les restaurants https://hotel-tilleul.fr/. The Customer, or the third party chosen by the Customer to ensure delivery, must then ensure that the Products are kept in good condition.

The Customer must consume the Products ordered within the “Use By” date indicated on the packaging and in accordance with the storage instructions indicated on the Product packaging.

Article 5.2. Order procedure
Orders for Products to be collected from restaurants are placed directly on the Site.
To place an Order, the Customer must follow the steps described below (please note, however, that depending on the Customer’s start page, the steps may differ slightly).

5.2.1. Control mode selection
When ordering online on the Site, the Customer is first invited to choose his or her ordering method:
– Delivery
For Delivery, the Customer is invited to select the desired delivery platform in order to be redirected to the restaurant page of the said platform. The Customer exits the Site, and the ordering, delivery and payment process is then entirely delegated to the platform.
– To take away.
To collect the Products, the Customer must search for and choose a Restaurant.

5.2.2. Product selection
The Customer must select the Product by clicking directly on the desired reference. Once the Product has been selected, it is placed in the Customer’s basket. Items may be added to the Customer’s basket as follows

5.2.3. Controls
Once the Products have been selected and placed in the basket, the Customer must check that the contents of his/her Order are correct in the “My Order” summary, then click on the “Confirm my order” button.

An online form allows the Customer to :
– Log in with your e-mail address and password
– Create a customer account
– Proceed to the next step without logging in or creating an account. In this case, the Customer will be asked for his First Name, Last Name and Telephone Number only, so that https://hotel-tilleul.fr/ can contact him in the event of a problem with the Order process.

The customer is then directed to the secure payment module to pay for the Order.
The Customer is invited to check the contents of his/her Order (including quantity, characteristics of the Product ordered, address of the Restaurant for collection and price) before validating its contents.
The Customer may then proceed to pay for the Product by following the instructions on the Site. Validation and payment of the Order by the Customer implies acceptance of the terms and conditions of sale.
Once the Customer has made payment on the Site, he may not cancel or modify his Order.

5.2.4. Acknowledgement of receipt
Once all the steps described above have been completed, a page appears on the Site to acknowledge receipt of the Customer’s Order. The order summary will also be sent to the e-mail address provided during the order process.

Article 5.3. Order date
The date of the Order is the date on which https://hotel-tilleul.fr/ acknowledges online receipt of the Order. The lead times indicated on the Site only begin to run from this date.

Article 5.4. Prices
On the Site, the Customer will find the price of the Product displayed in euros, inclusive of all taxes.
In particular, the price includes value-added tax (VAT) at the rate applicable on the date of the Order. Any change in the applicable rate may have an impact on the price of the Products from the date on which the new rate comes into force.

The applicable VAT rate is expressed as a percentage of the value of the Product sold.
Prices from https://hotel-tilleul.fr/ suppliers are subject to change. Consequently, the prices indicated on the Site may change. They may also be modified in the event of special offers or sales.
The prices indicated are valid, except for gross errors. The applicable price is that indicated on the Site on the date the Order is placed by the Customer.

Article 5.5. Product availability
https://hotel-tilleul.fr/ s’engage à remettre le Produit à la date ou dans le délai indiqué au Client, sauf si les parties en ont convenu autrement.
Only available Products are offered on the Site.
In any event, if unavailability was not indicated at the time the Order was placed, https://hotel-tilleul.fr/ undertakes to inform the Customer without delay if the Product is unavailable.

If the Customer decides to cancel his Order for an unavailable Product, he will be reimbursed for all sums paid for the unavailable Product no later than fourteen (14) days following the date on which the contract was cancelled.

Article 6: Right of withdrawal
In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to Products sold on the Site which are likely to deteriorate or expire rapidly.

The terms and conditions of the right of withdrawal are set out in the “Withdrawal Policy”, which is available in Appendix 3 hereto.

Article 7: Payment
Article 7.1. Payment methods
The Customer may pay for his Product online for collection in a Restaurant on the Site using the means proposed by https://hotel-tilleul.fr/, i.e. by :
– Credit card
– Edenred card, Bimpli, Moneo Resto, Digibon, SWILE, Pass Restaurant, Natixis Apetiz, UP Chèque Déjeuner
– G-Pay, Apple-Pay, Samsung-Pay
– Promotional codes

The customer guarantees https://hotel-tilleul.fr/ that he/she holds all the authorizations required to use the chosen means of payment.

https://hotel-tilleul.fr/ prendra toutes les mesures nécessaires pour garantir la sécurité et la confidentialité des données transmises en ligne dans le cadre du paiement en ligne sur le Site.
It is hereby specified that all payment information provided on the Site is transmitted to the Site’s bank and is not processed on the https://hotel-tilleul.fr/ Site.

Article 7.2. Payment date
In the case of a single payment by credit card, the Customer’s account will be debited as soon as the Product Order is placed on the Site.
If the Customer decides to cancel his/her Order for unavailable Products, the refund will be made in accordance with the last paragraph of article 5.5 of these General Terms and Conditions.

Article 7.3. Refusal of payment
If the bank refuses to debit a bank card, the Customer must contact https://hotel-tilleul.fr/ Customer Service in order to pay for the Order by any other valid means of payment accepted by https://hotel-tilleul.fr/.
In the event that, for any reason whatsoever, opposition, refusal or other, the transmission of the flow of money due by the Customer proves impossible, the Order will be cancelled and the sale automatically terminated.

Article 8: Proof and archiving
Any contract concluded with the Customer corresponding to an Order amounting to more than 120 euros including VAT will be archived by the https://hotel-tilleul.fr/ site for a period of ten (10) years in accordance with article L. 213-1 of the French Consumer Code.
HOTEL MUNIER AU TILLEUL agrees to archive this information in order to monitor transactions and to produce a copy of the contract at the Customer’s request.
In the event of a dispute, HOTEL MUNIER AU TILLEUL will be able to prove that its electronic tracking system is reliable and that it guarantees the integrity of the transaction.

Article 9: Transfer of ownership
HOTEL MUNIER AU TILLEUL remains the owner of the Product ordered until it has been paid for in full by the Customer.
The above provisions do not prevent the transfer to the Customer, at the time of delivery to the Customer or by a third party designated by the Customer, of the risks of loss or damage to the Product which is subject to the retention of title, as well as the risks of damage which they may entail.

Article 10: Delivery
The terms and conditions of Product delivery are set out in the “Delivery Policy”, which is available in Appendix 1 hereto.

Article 11: Withdrawal
The terms and conditions for the Withdrawal of Products are set out in the “Withdrawal Policy”, which is available in Appendix 2 hereof.

Article 12: Warranties
Article 12.1. Warranty of conformity
Article L. 217-4 of the French Consumer Code: “The seller delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery.
He shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter is his responsibility under the contract or has been carried out under his responsibility”.

Article L.217-5 of the French Consumer Code: “The goods conform to the contract:
Whether it is fit for the use ordinarily expected of similar goods and, if so ;
if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model; if it has the qualities that a buyer may legitimately expect in view of the public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller’s attention and accepted by the latter”.

Any action resulting from a lack of conformity must be brought within two (2) years of delivery of the Product. (Article L.217-12 of the French Consumer Code) In the event of a lack of conformity, the Customer may request the replacement or repair of the Product, at his or her option. However, if the cost of the Customer’s choice is manifestly disproportionate to the other possible option, given the value of the Product or the importance of the defect, https://hotel-tilleul.fr/ may proceed with a refund, without following the option chosen by the Customer.
In the event that replacement or repair is impossible, https://hotel-tilleul.fr/ undertakes to refund the price of the Product within thirty (30) days of receipt of the returned Product and in exchange for the return of the Product by the Customer to the following address:

Finally, the customer is exempted from proving the existence of a defect in the conformity of the Product for a period of twenty-four (24) months following delivery of the Product, except for second-hand goods for which this period is six (6) months (Article L. 217-7 of the French Consumer Code).
It is specified that the present legal warranty of conformity applies independently of the commercial warranty granted, where applicable, on the Product.
Article 12.2 Warranty against hidden defects
https://hotel-tilleul.fr/ est tenue de la garantie à raison des vices cachés du Produit vendu qui le rendent impropre à l’usage auquel on le destine, ou qui diminuent tellement cet usage que le Client ne l’aurait pas acquis, ou n’en aurait donné qu’un moindre prix, s’il les avait connus. (Article 1641 of the French Civil Code)
This guarantee allows the Customer, who can prove the existence of a hidden defect, to choose between reimbursement of the price of the Product if it is returned, or to keep the Product and have part of the price returned. (Article 1644 of the French Civil Code)
The action resulting from redhibitory defects must be brought by the Customer within two (2) years of the discovery of the defect (Paragraph 1 of Article 1648 of the French Civil Code).
In accordance with the provisions of Directive (EU) 2019/771 of the European Parliament and of the Council of May 20, 2019, as certain Products offered for sale are perishable goods, the presumption that the lack of conformity existed at the relevant time for establishing conformity may be incompatible with the nature of these goods.

Article 13: Liability
https://hotel-tilleul.fr/ – HOTEL MUNIER AU TILLEUL shall under no circumstances be held liable for the non-performance or improper performance of contractual obligations attributable to the Customer, in particular when entering his/her Order.

https://hotel-tilleul.fr/ – HOTEL MUNIER AU TILLEUL ne pourra être tenue pour responsable, ou considérée comme ayant failli aux présentes, pour tout retard ou inexécution, lorsque la cause du retard ou de l’inexécution est liée à un cas de force majeure telle qu’elle est définie par la jurisprudence des cours et Tribunaux français.

HOTEL MUNIER AU TILLEUL has no control over websites linked directly or indirectly to the Site. Consequently, it accepts no responsibility for the information published there. Links to third-party websites are provided for information purposes only and no guarantee is given as to their content.

HOTEL MUNIER AU TILLEUL shall not be held liable in the event of the Customer’s allergy to one of the ingredients of the Product which was clearly and legibly indicated on the Product sheet.

Article 14: Force Majeure

HOTEL MUNIER AU TILLEUL may not be held liable if the non-performance or delay in the performance of any of its obligations described in these General Terms and Conditions of Sale is due to force majeure.

Force majeure in contractual matters occurs when an event beyond the debtor’s control, which could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures, prevents the debtor from fulfilling his obligation.

If the impediment is temporary, performance of the obligation is suspended unless the resulting delay justifies termination of the contract. If the impediment is definitive, the contract is terminated ipso jure and the parties are released from their obligations under the conditions set out in articles 1351 and 1351-1 of the French Civil Code.

In the event of any of the above events, HOTEL MUNIER AU TILLEUL will endeavour to inform the Customer as soon as possible.

Article 15: Personal data
All consumers have the option of registering free of charge on the BLOCTEL telephone anti-solicitation list https://conso.bloctel.fr/index.php/inscription.php

In accordance with law no. 2020-901 of July 24, 2020 aimed at regulating telephone canvassing and combating fraudulent calls, any professional reserves the right to canvass a consumer registered on the telephone canvassing opposition list when the canvassing takes place as part of the performance of a current contract and is related to the subject matter of said contract, including when it involves offering the consumer products or services related to or complementary to the subject matter of the current contract or of a nature to improve its performance or quality.

HOTEL MUNIER AU TILLEUL collects personal data concerning its Customers on the https://hotel-tilleul.fr/ Site, in order to manage and monitor accounts and contracts, provide and manage services, manage payment, manage requests for information, manage recruitment, manage requests for rights, ensure the proper functioning and ongoing improvement of the Site and its functionalities, and if the Internet user has expressly chosen this option, send him/her newsletters, unless he/she no longer wishes to receive such communications from https://hotel-tilleul.fr/.

In this respect, the Customer is invited to consult the HOTEL MUNIER AU TILLEUL Privacy Policy, which can be accessed directly on the HOTEL MUNIER AU TILLEUL website and which will provide the Customer with further information on the protection of personal data, the processing carried out via the Site and the procedures for exercising rights.

Article 16: Complaints – Customer service
Any written complaint by the Customer must be sent to :

Article 17: Validity of the General Terms and Conditions of Sale
Any modification of the legislation or regulations in force, or any decision by a competent court invalidating one or more clauses of the present General Terms and Conditions of Sale shall not affect the validity of the present General Terms and Conditions of Sale. Any such modification or decision shall in no way authorize Customers to disregard these General Terms and Conditions of Sale.

Any terms and conditions not expressly dealt with herein shall be governed in accordance with usage in the retail sector, for companies whose registered office is located in France.

Article 19: Modification of the General Terms and Conditions of Sale
The present General Terms and Conditions of Sale apply to all purchases made online on the Site, for as long as the Site is available online.

The General Conditions are dated precisely and may be modified and updated by HOTEL MUNIER AU TILLEUL } at any time. The General Conditions applicable are those in force at the time of the Order.

Changes to the General Terms and Conditions will not apply to Products already purchased.

Article 20: Jurisdiction and applicable law
These general terms and conditions and the relationship between the customer and HOTEL MUNIER AU TILLEUL are governed by French law.
In the event of a dispute, the French courts shall have exclusive jurisdiction.
However, prior to any recourse to an arbitral or state judge, the Customer is invited to first contact HOTEL MUNIER AU TILLEUL’s Customer Service at hello@lapapa .fr in order to resolve the dispute amicably.
If this approach fails, the Customer may have recourse to the services of a mediation and arbitration center in the Hauts-de-Seine region.

To be admissible, a referral to a mediation and arbitration center must include: your postal, e-mail and telephone contact details, as well as the full name and address of our company, a brief statement of the facts, and proof of any prior steps taken.

In accordance with the rules applicable to mediation, you are reminded that a consumer dispute must first be referred in writing to HOTEL MUNIER AU TILLEUL’s Customer Service before any request for mediation can be made to a mediation and arbitration center.

Disputes may not be reviewed by the mediator if the request is manifestly unfounded or abusive, or has been previously examined or is in the process of being examined by another mediator or by a court, or if the consumer has lodged his request with the mediator more than one year after his written complaint to HOTEL MUNIER AU TILLEUL or if the dispute does not fall within the mediator’s field of competence, or if the consumer does not justify having previously attempted to resolve his dispute directly with HOTEL MUNIER AU TILLEUL by means of a written complaint in accordance with the aforementioned procedures.

The Party wishing to initiate the mediation process must first inform the other Party by registered letter with acknowledgement of receipt, indicating the elements of the dispute.

Since mediation is not compulsory, the Customer or HOTEL MUNIER AU TILLEUL may withdraw from the process at any time.

In the event that mediation fails or is not envisaged, the dispute which may have given rise to mediation will be referred to the competent court designated above.

APPENDIX 1: DELIVERY POLICY

Delivery zone
The Products offered can only be delivered within the Territory, provided that the delivery platform chosen by the Customer agrees to deliver to the address indicated by the Customer. Unless the delivery platform chosen by the customer agrees to accept delivery, it is impossible to place an order for any delivery address outside this Territory.

Delivery times & costs
The ordering process for deliveries is entirely delegated to the delivery platform chosen by the Customer. During the ordering process, the delivery platform will indicate to the Customer the possible delivery times and shipping formulas for the Products purchased.
Delivery will be invoiced to the Customer directly by the delivery platform. The cost (including VAT) is variable and depends on the platform selected by the Customer. The amount of these costs will be payable by the Customer in addition to the price of the Products purchased.
Details of delivery times, delivery charges, commissioning charges and any other charges will be indicated to the Customer by the delivery platforms. The Customer is free to accept or reject these conditions.

Terms of delivery
The Customer accepts that his Order may be handed over to the delivery agent of his choice so that the latter may carry out the delivery service. The Customer undertakes to take delivery of the Products at the delivery address indicated on the delivery platform, on the day and at the time chosen. In the event of absence, or if the Customer is not clearly identifiable at the delivery address using the information transmitted when the Order was placed, the Customer will be contacted by telephone on the number used to place the Order. If the Customer does not respond, the Order will be lost. The Customer will not be entitled to a refund.

Delivery problems
https://hotel-tilleul.fr/ est responsable du Produit jusqu’à la remise de la Commande au livreur de la plateforme de livraison choisie par le Client.

APPENDIX 2: WITHDRAWAL POLICY

Withdrawal principle
Products ordered on the Site by the Customer must be collected from the selected Restaurant.

Withdrawal zone
The Product may be collected from the Restaurant chosen during the Order process.

Pick-up times
The Order will be available at the Restaurant at the time chosen by the Customer when placing the Order.
The Customer may collect the Order from the chosen Restaurant at the chosen time.

Withdrawal times
The Order is held for an additional 1 hour from the selected time.

Withdrawal procedure
The Product will be delivered to the Customer upon provision of the Order number or the QR code provided in the Order confirmation e-mail or the Customer name used for the Order.

APPENDIX 3: WITHDRAWAL POLICY

In accordance with article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to Products sold on the Site which are likely to deteriorate or expire rapidly.

For other Products, the Customer may exercise his right of withdrawal in accordance with the provisions detailed below.


Principle of withdrawal

In principle, the customer has the right to withdraw from the contract by returning or returning the Product to https://hotel-tilleul.fr/ without giving any reason.
To this end, the Product must be returned or restituted at the latest within fourteen (14) days of the communication of the decision to withdraw, unless https://hotel-tilleul.fr/ offers to collect the Product itself.

Cooling-off period
The withdrawal period expires fourteen (14) days after the day on which you, or a third party designated by you, takes physical possession of the goods.

Notification of right of withdrawal

In order for the withdrawal period to be respected, the Customer must transmit his communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

Effects of withdrawal
In the event of withdrawal by the Customer, HOTEL MUNIER AU TILLEUL undertakes to reimburse all sums paid, without undue delay, and at the latest within fourteen (14) days from the date on which it is informed of the Customer’s decision to withdraw (Article L.221-24 of the French Consumer Code).

Unless HOTEL MUNIER AU TILLEUL offers to collect the Product itself, HOTEL MUNIER AU TILLEUL may defer reimbursement until it has collected the Product or until the consumer has provided proof of shipment of the Product, whichever is the earlier.

HOTEL MUNIER AU TILLEUL will make the refund using the same means of payment that the Customer used for the initial transaction, unless the Customer expressly agrees to use another means of payment and insofar as the refund does not incur any costs for the Customer.

Return policy
In any event, the Customer must return or restitute the goods to HOTEL MUNIER AU TILLEUL – https://hotel-tilleul.fr/ – 43 rue Léon Jouhaux – Bâtiment n°10 – 78500 SARTROUVILLE – FRANCE, no later than fourteen (14) days after communicating his/her decision to withdraw from this contract.
This period is deemed to have been respected if the Customer returns or restitutes the goods before the expiry of the fourteen (14) day period.

Return shipping costs
The Customer shall bear the direct cost of returning the goods.

Condition of returned goods
The Product must be returned in accordance with the instructions provided by https://hotel-tilleul.fr/ and include all the accessories supplied. The Product must not be unsealed.
The Customer shall only be liable for any loss of value resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the Product. In other words, the Customer may test the Product, but may be held liable for any manipulations other than those necessary.

Exclusions from the right of withdrawal
In particular, the right of withdrawal is excluded in the following cases:
– Supply of goods likely to deteriorate or expire rapidly
